These Terms of Service ("Terms") govern freelance web and mobile app development engagements between DarskeeWorks (Daril Quervo, "we", "us") and the client ("you"). Terms specific to an individual project are agreed in writing (email or messaging) before work begins and take precedence over this general page where they differ.
Services covered by these Terms include website development, mobile app development, and related consulting, as described on our Services page. The specific scope, deliverables, and price for a project are agreed before work starts. Work outside that agreed scope is treated as a change request and may require an updated quote and timeline.
Each project includes 2 rounds of revisions within the agreed scope. Additional revision rounds, or changes outside the original scope, are billed separately or added to the timeline by agreement.
Estimated delivery timelines are provided at the start of a project and depend on scope, complexity, and how quickly you provide feedback and required materials (content, assets, credentials). Delays on your side may shift the delivery date accordingly.
Once a project is paid in full, ownership of the final deliverables (source code, designs, and assets created specifically for you) transfers to you, excluding any third-party libraries, frameworks, or licensed assets, which remain governed by their own licenses. DarskeeWorks may retain the right to display the finished work in its portfolio unless you request otherwise in writing.
Bug fixes for issues present at delivery are covered for 30 days after handoff. Ongoing maintenance, new features, or hosting after that period can be arranged separately.
DarskeeWorks will make commercially reasonable efforts to deliver working, reliable software, but does not guarantee the service will be error-free or uninterrupted. To the extent permitted by law, DarskeeWorks' liability for any claim arising from a project is limited to the amount paid for that project. We are not liable for indirect or consequential damages, including lost profits or data loss, except where caused by our gross negligence or willful misconduct.
Either party may cancel a project in writing. If you cancel after work has started, the deposit and any completed milestone payments are non-refundable, covering work already performed; any additional work completed beyond that is billed at the agreed rate.
These Terms are governed by the laws applicable to DarskeeWorks' place of business, without regard to conflict-of-law principles, unless a specific project agreement states otherwise.
